Senate Passes GAIN AI Act in the NDAA

Bill would require chip makers to sell to US companies first

 

On Thursday, the Senate passed the National Defense Authorization Act, including bill text for the GAIN AI Act, legislation that would require chip sellers to fulfill purchases from US-based customers before selling advanced AI chips to "countries of concern."

 

The legislation comes as Nvidia develops a new “B30A” chip for Chinese markets, a Blackwell-based GPU more powerful than both the H20 and H100 and engineered to push the limits of U.S. export limits. The NDAA now goes to conference to resolve differences between the Senate and House versions of the legislation.

 

“In the Senate, it’s a badge of honor to put the U.S. first,” said ARI President Brad Carson. “As we work to keep the U.S. ahead on AI development, we need advanced AI chipmakers to sell to American companies before going to countries of concern. The GAIN AI Act is a major win for U.S. economic competitiveness and national security.”

 

Last month, ARI and American Compass sent a letter urging the Senate to keep the GAIN AI Act in the National Defense Authorization Act (NDAA).

 

Over the past several years, U.S. firms have faced regular backlogs in purchasing chips. In late 2024, Nvidia’s Blackwell line was booked out roughly 12 months ahead. In an earnings call in August, Nvidia CEO Jensen Huang said with regards to chips that, “everything’s sold out.”
